Expertise in employee rights

Employee rights in the Israeli legal system derive by virtue of Basic Laws, protective labor laws, collective agreements, extension orders, individual contracts and different rules and regulations. All of the above are intended to regulate employment relations and prevent violation of employee rights.

 

Summary of social rights and benefits in Israel

Severance pay

An employee who worked one continuous year - and for a seasonal worker, two consecutive years - with one employer or one workplace, and was dismissed, is entitled to receive from his employer severance pay. Payment of remuneration for overtime

In accordance with Hours of Work and Rest Law, remuneration for overtime for an employee in full time position is 125% for the first two hours beyond the workday and 150% for the third hour onwards. Pursuant to Section 5 to the Wage Protection Law, an employer is prohibited from setting global salary that already grosses consideration for overtime and/or annual leave, except for specific circumstances. Payment of wages for holidays

The right for wages for holidays prescribes that an employee receiving monthly wages is entitled for payment for holidays. An employee for daily wages who worked no less than three months shall be entitled for payment for two years in Rosh Hashanah, Yom Kippur, two days for Succoth, two days for Passover, Shavuot and Independence Day. An employee who is not Jewish is entitled to receive payment for holidays according to his religion. Sickness pay

An employee is entitled to receive 18 sickness days per year paid from the second day. The second and third day of sickness shall entitle the employee with 37% of the wages and from the fourth day onwards 75% of the daily wages. Sickness days can be accrued up to a quota of 90 days. Right for convalescence pay

Contrary to other employee rights that were specified, the right to receive convalescence pay is not prescribed by law but in a general collective agreement to which an extension order was added. The purpose of this right is to assist an employee who works at least one year in the workplace to go on vacation and return reinvigorated to his workplace. The value of a convalescence day in the private sector amounts to NIS 365 per day and NIS 411 in the public sector per each day of convalescence. The number of convalescence days for payment is contingent upon sector and seniority. Provision for pension

In the beginning of 2008 a new law providing protection to employee rights came into force this is the extension order for obligatory pension in the market. This order obligates employers to make provisions for employees for pension insurance for the employee. National Insurance

The National Insurance Institute of Israel acts by virtue of the National Insurance Institute of Israel Law 1953 for the purpose of providing a "social security network" to citizens of the state.  Among the areas that the National Insurance Institute of Israel is responsible for, are work injuries, general disability, entitlement in accordance with mobility agreement, victims of terrorist acts and treatment of Polio and scalp ringworm (tinea capitis). In such events the National Insurance Institute of Israel can assist insureds by providing grants, pensions, and different reliefs.

 

Medical board

When a claim is filed to the National Insurance Institute of Israel for work related accidents, professional sickness, general disability,  Polio and scalp ringworm (tinea capitis), and more, in order to set the level of compensation and the degree of disability, the claimant has to appear before a medical board of the National Insurance Institute of Israel. Since the conclusions of the medical board will determine the percentage of disability and, consequently, the amount of compensation and rate of pension and annuity, it is very important to be prepared when appearing before the medical board. Furthermore, most appearances before the medical boards are for a number of minutes and therefore, in order to ensure that you will be able to provide all the relevant information in one or two minutes, you should come well prepared.

Remuneration officer

A remuneration officer is in charge of acknowledging the rights of persons injured in the defense forces. Whoever is eligible to be recognized as injured is anyone who was injured while and following service in one of the following: the IDF, Israel Police, the Israel Prison Service, Israel Security Agency, the Mossad, the Knesset Guard and any other service declared by the Minister of Defense as military service and that as a result of the injury the person was incapable to work temporarily or permanently and suffered disability due to the injury. Exemption from income tax

Blind, disabled persons with 100% disability degree, persons with 90% disability degree due to injuries to organs and whoever is permanently disable with a disability degree of 89% may be entitled to receive exemption from income tax. A person who was injured as a result of sickness or a work related accident and his claim was accepted by the National Insurance Institute of Israel will be requested to appear before a medical board of the National Insurance Institute of Israel. The purpose of these medical boards is to examine the injury and establish a disability degree according to National Insurance Institute of Israel regulations.
